These Terms of Service ("Terms," or "Agreement") constitute a legally binding agreement between you ("you," "user," "member") and OMZ Charts ("OMZ," "we," "us," "our") — an individually-operated trading-education service (not a registered company), run by the creator behind the @omzcharts account on X — regarding your access to and use of:

• The OMZ Charts website at omzcharts.com
• The OMZ Charts Discord community
• Any @omzcharts social media communications on X
• Any membership access or billing managed through X's Creator Subscriptions platform

By accessing OMZ Charts, you agree to these Terms.

1. Changes to These Terms

OMZ may modify these Terms, pricing, membership features, or website information at any time, for any reason. Changes take effect immediately when updated. Continued use of OMZ's services constitutes acceptance of the changes.

2. Eligibility

You must be:

• 18+ years old
• Capable of entering legally binding agreements
• Not restricted from accessing financial-education content

Users accessing from outside the U.S. do so at their own initiative and must comply with local laws.

3. Description of Services

OMZ provides:

• Educational content related to cryptocurrency and equities/stocks
• Real-time setups, which are personal trades executed by OMZ
• Market commentary
• Risk-management education ("risk frameworks")
• Educational discussion and general feedback shared through weekly videos and the Discord community
• A private Discord community for learning and communication

OMZ does NOT provide:

• Investment advice
• Trading signals
• Buy/sell/hold recommendations
• Personalized financial guidance
• Broker-dealer services
• Financial planning
• Legal or tax advice
• A promise of profitability or reduced losses

OMZ's educational content may reference or discuss various asset classes, including but not limited to cryptocurrency, equities/stocks, and other financial instruments. All such references are provided strictly for educational and informational purposes only.

4. Nature of Real-Time Setups

"Real-time setups" shown inside OMZ's private feed are:

• Personal trades executed by OMZ
• Shared for educational and informational purposes only
• Demonstrations of OMZ's own process, decision-making, and risk-management approach

Real-time setups:

• Are NOT signals
• Are NOT trade alerts
• Are NOT recommendations
• Do NOT guarantee outcomes
• Do NOT create any advisor-client relationship

You acknowledge that all trade decisions you make are your own.

5. Role of OMZ's Commentary & Educational Content

OMZ's videos, analysis, and Discord participation:

• Provide educational commentary only
• Help users understand technical analysis, risk management, and general trading concepts
• Offer opinions and general feedback in response to questions
• Do NOT provide individualized advice
• Do NOT assess your financial situation
• Do NOT tell you what to buy or sell
• Do NOT take responsibility for your trade decisions

All commentary and discussion inside OMZ's private feed and Discord is educational in nature.

6. Intellectual Property Rights

All OMZ content — including trade setups, Discord messages, videos, graphics, PDFs, charts, market explanations, processes, personal trade breakdowns, and teaching materials — is proprietary. Users may NOT:

• Copy, save, screenshot, record, distribute, or share OMZ's content
• Publish or resell OMZ's materials
• Upload OMZ's content elsewhere
• Create derivative works
• Share access to the Discord with others
• Post OMZ's content on social media

Violations may result in immediate termination, loss of access without refund, and legal action, including damages.

7. Payments, Subscriptions & Refunds

All billing, authentication, renewals, and cancellations are handled exclusively by X (Twitter) through its Creator Subscriptions platform.

• OMZ does not collect or store payment data
• Subscriptions renew automatically each month
• Users must cancel through their X account settings before the next billing period
• Subscribing through desktop is recommended — mobile app purchases are subject to an additional platform fee charged by the app store, not by OMZ
• OMZ does NOT offer refunds

Disputes, chargebacks, or billing issues fall under X's Terms, not OMZ's.

8. Termination of Access

OMZ may terminate your membership at any time, with or without notice, for violations of these Terms, violations of the Discord's rules, abusive or harmful behavior, attempted redistribution of content, market manipulation or illegal activity, or security risks / community disruption.

If terminated: you may not rejoin with new accounts, remaining subscription time is forfeited, and OMZ may pursue civil or legal remedies for damages.

9. Modifications & Service Interruptions

OMZ may modify or remove content at any time. OMZ does not guarantee uptime or availability of Discord, X (including its Creator Subscriptions platform), the OMZ Charts website, educational materials, or real-time setups. OMZ is not liable for downtime, interruptions, or changes to features, pricing, or availability.

10. No Financial, Legal, or Investment Advice

All OMZ content — real-time setups, market commentary, educational posts, Discord discussions, risk-management explanations, charts, videos, examples, and social media activity — is intended solely for general educational purposes. Nothing from OMZ should be interpreted as investment advice, signals or alerts, guidance tailored to your personal situation, a recommendation to buy or sell, or a guarantee of results.

You are exclusively responsible for your financial decisions. This disclaimer applies equally to all asset classes discussed by OMZ, including cryptocurrency, equities/stocks, and any other financial instruments.

11. Market Risk Acknowledgement

By using OMZ's services, you acknowledge that trading involves significant financial risk, you may lose part or all of your capital, past performance does not guarantee future outcomes, and educational material may be incomplete, delayed, or inaccurate. OMZ is not responsible for your trading results.

12. External Communications & Social Media Content

12.1 Accounts Covered

This clause applies to content posted on X (Twitter) or any social platform by @omzcharts.

12.2 Nature of Social Posts

All tweets, posts, charts, examples, commentary, and promotions are educational opinions and personal perspectives, shared for informational purposes only.

12.3 No Relationship Created

Social media activity does NOT create an advisory relationship, any fiduciary duty, or personalized guidance.

12.4 No Reliance

Users must not rely on tweets or posts to make financial decisions.

12.5 Advertising and Promotions

Any promotions for OMZ Charts on social media do not imply or guarantee results, do not constitute investment advice, and may include testimonials that are not typical.

12.6 Liability

OMZ is not liable for losses arising from reliance on tweets, misinterpretation of social content, or actions taken based on external posts.

13. User Conduct

Users may not harass members, threaten or abuse OMZ, engage in illegal activity, attempt to manipulate markets, impersonate OMZ, solicit users for other groups, share or steal proprietary content, or damage/disrupt systems or operations.

14. Client-to-Client Communications & Advice Disclaimer

OMZ's Discord community includes discussions between members. Any statements, opinions, trade ideas, commentary, or guidance shared by other users or members are not reviewed, endorsed, verified, or approved by OMZ. You acknowledge that other members are not representatives, agents, or advisors of OMZ; that OMZ is not responsible for the accuracy, completeness, or outcomes of information shared by other users; and that you rely on any client-to-client communication entirely at your own risk.

OMZ expressly disclaims all liability arising from advice or opinions given by members to other members, private messages, group discussions, voice chats, or direct communications between users, and any actions taken based on information shared by other members. Members are prohibited from presenting themselves as professionals, advisors, or representatives of OMZ. Any violation may result in removal or termination without refund.

15. Partnerships, Referral Links & Third-Party Platforms

OMZ may provide users with access to or promotional links for third-party platforms, including but not limited to cryptocurrency exchanges, trading platforms, prop firms and funded account programs, brokerages, tools/software/services, educational partners, and affiliate or referral programs. Any such links or partnerships are offered for convenience only and do not constitute recommendations, endorsements, financial advice, solicitation, or guarantees of approval, profitability, or success.

OMZ may receive commissions, referral fees, or other compensation from certain partners — assume that any outbound link may be an affiliate link. OMZ is not responsible for the performance, security, reliability, or policies of third-party services; does not control account approvals or decisions made by exchanges, prop firms, or brokers; and is not liable for losses, fees, outages, account restrictions, or actions taken by any partner platform. You sign up for third-party services at your own risk, and participation in any referral or affiliate program is completely optional.

16. Communications Outside OMZ's Platforms

OMZ's educational disclaimers, limitations of liability, and absence of any advisory relationship apply to all communications, regardless of format or platform — including direct messages, calls, in-person conversations, and communications with prospective users who have not yet subscribed. No communication, regardless of medium, creates an advisor-client, fiduciary, or professional relationship between OMZ and any individual. You remain solely responsible for all decisions you make based on any information received, whether inside or outside OMZ's platforms.

17. Third-Party Tools & Integrations

OMZ uses Discord, X (including its Creator Subscriptions platform), our website hosting provider, and any analytics tools we may use in the future. OMZ is not responsible for failures, outages, breaches, or actions of third-party services.

18. Limitation of Liability

OMZ and anyone assisting in the operation of these services are not liable for trading losses, financial damages, lost profits, user mistakes, market volatility, account compromise, service outages, user reliance on educational content, or user decisions. Your sole remedy is to discontinue use of OMZ's services.

19. Indemnification

You agree to indemnify and hold OMZ harmless from claims, losses, or damages arising from your use of OMZ's services, your trading decisions, your violation of these Terms, your conduct in the Discord, or your reliance on social media content.

20. Governing Law

These Terms are governed by the laws of the State of California. OMZ does not intentionally target or solicit users located in the European Union or European Economic Area, and its services are intended primarily for users outside those jurisdictions.

At OMZ Charts ("OMZ," "we," "us"), we respect your privacy and are committed to protecting information related to your use of omzcharts.com, the OMZ Charts Discord community, and any related services. This Privacy Policy describes what information we collect, how we use it, how third-party platforms (X, Discord, and any analytics providers we may use) may process data, and your rights and choices. OMZ collects minimal information, and only what is necessary to operate our website and services.

At this time, omzcharts.com does not use cookies, pixels, analytics scripts, or advertising/retargeting tools. If any such tools are introduced in the future (for example, basic site analytics), this Policy will be updated and, where required, appropriate consent mechanisms will be added.

1.2 Communication Data

1.3 Social Media Interactions

If you engage with @omzcharts content on X or other platforms (likes, retweets, replies), your data is processed according to those platforms' policies. OMZ does not separately collect personal data from social media interactions.

2. Information We Do NOT Collect

OMZ does NOT collect or store payment information, credit card or billing details, government-issued identification, date of birth, addresses, or Social Security numbers. All payments and authentication are handled externally by X's Creator Subscriptions platform.

3. Third-Party Services and Integrations

OMZ uses third-party platforms to deliver its services. Each platform has its own privacy policy that governs how it collects and processes data.

3.1 X (Twitter) — Payments, Authentication, Subscriptions

X handles membership sign-ups, payment processing, billing information, subscription renewals, and account authentication. OMZ does not access, store, or manage any payment information. Please refer to X's Privacy Policy for details.

3.2 Discord (Community Access)

Participation in the OMZ Charts Discord means Discord may collect your Discord username and user ID, messages you send, server activity, IP address, and device/browser metadata. Your Discord data is governed by Discord's Privacy Policy. OMZ does not download, extract, or sell Discord user data.

3.3 Analytics, Cookies & Tracking Tools

OMZ Charts does not currently use cookies, pixels, analytics scripts, conversion-tracking tools, or retargeting tools on omzcharts.com. You may also disable cookies in your browser settings at any time as an additional precaution.

3.4 X (Twitter) and Social Media

@omzcharts may share posts, promotions, and educational content on X. OMZ does not collect personal data from your interactions with that account. Your data is governed by X's privacy policies.

4. How We Use Data

OMZ uses any information described above to respond to users who contact us first, maintain the secure functioning of the site, and — with your explicit permission — publish testimonials, reviews, or feedback (including content you share within the Discord), which may be displayed on our website or social media accounts.

OMZ does not sell your personal data, share identifiable data with advertisers, use data to track individual trading behavior, or combine any data with Discord or X account data.

Public Display of Community Content

OMZ may share screenshots, excerpts, or anonymized content from within the OMZ Charts Discord community, or from the private subscriber feed, for educational, marketing, or promotional purposes — including on our website or social media platforms. By participating in the OMZ Charts Discord or private feed, you acknowledge that your username, messages, or interactions may be visible in such content. OMZ will make reasonable efforts to remove or obscure personal identifiers upon request.

5. Sharing of Information

OMZ may share anonymous data with our website hosting provider or security/anti-spam services, as needed to operate the site. If analytics or advertising tools are added in the future, anonymous data may also be shared with those providers. OMZ does NOT sell or rent your personal information. OMZ may disclose data if required by law or to protect our rights.

6. Data Retention

OMZ retains messages sent to us directly (e.g., via X) as needed to maintain communication history. We do not store sensitive personal data. Discord and X manage their own retention schedules for your data on their own platforms.

7. EU / EEA Data Protection Notice (GDPR)

OMZ Charts is U.S.-based and does not specifically target, market to, or direct its services toward individuals located in the European Union (EU) or European Economic Area (EEA). Our website, Discord community, and services are offered globally but are not tailored to EU/EEA users, currencies, languages, or regulatory frameworks.

If an EU/EEA resident voluntarily accesses OMZ's website or services, they acknowledge that OMZ processes only minimal information necessary to operate its services; OMZ does not directly collect or store sensitive personal data; payments, subscriptions, authentication, and account management are handled by X, which acts as an independent data controller; and community participation occurs on Discord, which independently controls and processes user data under its own GDPR-compliant policies.

OMZ does not use non-essential cookies, advertising pixels, or behavioral profiling targeted at EU/EEA users. If such tools are introduced in the future, OMZ will implement appropriate consent mechanisms where required.
